Court Of Appeals Gives HISA Partial Stay Of Louisiana Injunction

Court of Appeals for the Fifth Circuit in New Orleans, La., grants partial stays of a July 25 injunction from a U.S. District Court judge. The injunction would have prohibited HISA from enforcing its racetrack safety regulations in Louisiana and West Virginia. A lawsuit claimed the FTC did not provide sufficient time for public comment before approving certain regulations.

Court of Appeals grants HISA partial stay of Louisiana injunction. The appeal will be expedited to a September 2022 oral argument sitting. The current Investigatory Powers regulations may not be enforced in Louisiana or West Virginia. Horses will still need to be registered in order to race in all states, including Louisiana and WestVirginia. Hisa adopted a funding formula beneficial to states with lower purses.
